Notice
of Commencement:
In accordance with Section 713.13 of the Florida
Statutes, a Notice of Commencement, or NOC is
required for the construction of, improvements to,
alteration of, or repair of real property that
construction value is over $2,500. The Notice of
Commencement must be recorded with that county’s
office of the clerk where the real property is
located.
This form
must be signed and notarized by the owner or tenant
on the property depending on who is paying for the
construction work. In South Florida, most of the
Notice of Commencements have 2 places on the form
for the owner’s signature. The original filled out
document is then taken to that county’s office of
the clerk to have recorded. It is advised to also
request a certificated copy for your records. For
most cities in Miami Dade county, the recorded
Notice of Commencement is required to be on the
jobsite for the first inspection. For most cities in
Broward, and Palm Beach counties, the recorded
Notice of Commencement is required to be turned in
to the building department before the permit is
issued.
The
Notice of Commencement document protects the owner
from double payment to the contractor,
subcontractors and any material suppliers on the
project. It also protects the contractor,
subcontractors, and suppliers that in the event that
they do not receive payment for their services they
can record a lien on the property. The Notice of
Commencement is effective for 1 year from date of
recording unless a different expiration date is
specified. If a project is going to last longer than
a year, a more realistic expiration date should be
specified.
